Club Space operators file counterclaim against Insomniac

Accused of breaching agreements in Miami partnership dispute.

The legal dispute between Insomniac Holdings and the operators of Miami’s Club Space has intensified, with local partners filing a counterclaim in federal court.

David Sinopoli, Davide Danese, and Jose Coloma Cano — along with four affiliated companies, collectively known as CDD — accuse Insomniac and its founder, Pasquale Rotella, of breaching agreements, obstructing operations, and undermining their role in Miami’s nightlife economy. “This action arises from Insomniac’s and Rotella’s repeated betrayal of the CDD parties in selfish pursuit of their own financial interests,” the filing states.

The move follows Insomniac’s August 4th complaint, in which the company alleged that CDD had broken partnership terms at Factory Town, withheld revenues, and threatened a smear campaign against Rotella. That case, still active in federal court, centers on control and revenue disputes involving both Club Space and Factory Town.

A central issue involves two Miami events — the Halloween showcase Hocus Pocus and a December Art Week party. CDD claims Insomniac failed to collaborate, while Insomniac argues CDD acted without approval and misused Club Space branding.

Both cases are being heard in the U.S. District Court for the Southern District of Florida. CDD is seeking damages for breach of contract, breach of good faith, and interference with business operations.
